Getaway Gear Rentals

RENTAL TERMS AND CONDITIONS

Definitions

  • Rented Equipment: Any equipment, products, or property rented to the Client by Getaway Gear Rentals.

  • Client: Any person(s) who agrees to rent or reserves the Rented Equipment.

  • Company: Getaway Gear Rentals, a limited liability company based in Punta Gorda, FL, organized under Florida law.

  • Rental Period: The time for which the Client rents the Rented Equipment, including any additional time if the equipment is retained or not returned.

Rented Equipment and Rental Period

  • Rented Equipment: Client rents equipment from the Company as specified in the reservation. A delivery charge of $0 to $100 applies, and the Company will deliver and set up the equipment if requested. Proper setup and safety are the Client's responsibility.

  • Rental Period Extension: The Rental Period extends until the equipment is returned if not returned on time. No cost reduction for unused time or equipment. Extensions must be requested in advance and are subject to Company approval, with charges added to the Client’s credit card.

  • Delivery Details: Client must inform the Company at least 36 hours before delivery of the location, date, time, and the authorized person to accept delivery. The Client is responsible for arrangements.

Fees and Reservations

  • Fees: All fees are due at reservation time, varying by rental length and equipment type. The Client's credit card is charged for the full rental and delivery amount at reservation.

  • Reservations: Can be made online or by phone and must be secured with a valid credit card and contact number. The Company will confirm online reservations within 48 hours via email or phone.

Damaged or Lost Equipment

  • Responsibility: Client pays for replacement of lost, non-returned, or damaged equipment at the Manufacturer’s Suggested Retail Price (MSRP).

  • Inspection and Notification: Client must inspect the equipment upon receipt and immediately notify the Company of any issues. Failure to do so waives claims related to equipment condition.

  • Usage: Client must use the equipment according to manufacturer instructions provided by the Company. The Company is not liable for misuse or failure to follow instructions.

Indemnification and Release of Liability

  • Indemnification: Client indemnifies and holds the Company harmless from all claims, damages, and expenses arising from the use or misuse of the equipment.

  • Release: Client releases the Company from any liability for bodily injury, disability, death, loss, or damage, even if caused by Company negligence.

Cancellations

  • Refunds: . Reservations canceled more than 8 days in advance are eligible for a refund, and a 10% cancellation fee. Cancellations made 3-7 days prior will receive a 50% refund, while those made within 2 days of the reservation date are non-refundable. To cancel your reservation, please contact us via email for assistance. In the rare event that Getaway Gear must cancel your reservation, you will receive a full refund.

Miscellaneous

  • Governing Law: This Agreement is governed by Florida law. Any enforcement action must be brought in Charlotte County, Florida, or the applicable U.S. District Court.

  • Severability: If any part of this Agreement is found void or unenforceable, the remaining terms remain in effect.

  • Attestation: By accepting electronically, the Client agrees to and accepts these terms as legally binding as a pen-and-ink signature.
